Regulations for maintenance of Internet domains in MinistryOfAdvertising.com Sp. z o. o.

I. PRELIMINARY PROVISIONS

  1. These Regulations set out the rules for maintaining Internet domains at MinistryOfAdvertising.com Sp. z o. o. The Regulations apply regardless of the form in which the Customer concluded the Agreement.
  2. The Terms and Conditions are made available free of charge on the website https://ministry-of-advertising.com/wp-content/uploads/2025/03/regulamin-domeny.pdf in a form that makes it possible to obtain, reproduce, record by means of the information and communication system used by the Customer and to print it out. Anyone can read the content of these Regulations.
  3. The Service is operated by the company under the name of MinistryOfAdvertising.com Sp. z o. o. with its registered office in Tarnowskie Góry at 6/2 Styczyńskiego Street, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Gliwice, 10th Economic Department of the National Court Register under the KRS number: 0000376859; REGON: 241853339, NIP: 6452521002, hereinafter referred to as: MinistryOfAdvertising.com.
  4. These terms and conditions are at the same time an integral part of the transaction concluded between the Customer and MinistryOfAdvertising.com and, together with other documents drawn up at the conclusion of the contract of sale, constitute the fulfillment of the information obligation provided for by the content of Article 12 paragraph 1 and Article 18 of the Act of May 30, 2014 on Consumer Rights.
  5. MinistryOfAdvertising.com has the right to change the content of the Terms and Conditions as a result of changes in applicable laws and as a result of the introduction of new Services. MinistryOfAdvertising.com is obliged to inform the Customer of the changes. If the Customer does not terminate the agreement within 14 days from the delivery of the notice, it is deemed to accept the provisions of the new Regulations.

II. REFERENCE TO THE REGULATIONS FOR THE PROVISION OF SERVICES BY ELECTRONIC MEANS WITHIN THE MINISTRYREKLAMY.PL WEBSITE. CONFIRMATION OF KNOWLEDGE OF REGULATIONS

  1. To the extent not regulated in these Regulations, the provisions of the Regulations for the provision of services by electronic means within the framework of MinistryOfAdvertising.com, which regulate, among other things, the provision of services by electronic means by MinistryOfAdvertising.com sp. z o. o., the procedure for placing orders for individual services, including the Service defined herein, as well as any rights of the Customer related to the concluded agreement (including, among others, the right to withdraw from the agreement, the procedure for filing complaints, the procedure for resolving disputes) shall apply.
  2. Use of the Services by the Client confirms knowledge of the content of these Regulations and the Regulations for the provision of services by electronic means within the MinistryOfAdvertising.com website, as well as acceptance of their provisions.
  3. Access to information about changes in the manner and scope of providing services by MinistryOfAdvertising.com and to information required to be provided to Customers by applicable laws and regulations will be provided by MinistryOfAdvertising.com, among others, by posting relevant information within the Site.

III. DEFINITIONS

  1. Proforma document – a document issued by MinistryOfAdvertising.com before the payment is made and is the basis for the payment.
  2. Customer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality (with legal capacity and ability to perform legal actions), who uses the Service; When the Customer is not a natural person, it is presumed that he/she is represented by a representative authorized to represent the Customer under applicable laws.
  3. MinistryOfAdvertising.com – Service Provider – MinistryOfAdvertising.com Sp. z o. o. with its registered office in Tarnowskie Góry at 6/2 Styczyńskiego Street, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Gliwice, X Economic Department of the National Court Register under KRS number: 0000376859; REGON: 241853339, NIP: 6452521002.
  4. Billing Period – a period of time comprising 1 year or a multiple thereof, during which MinistryOfAdvertising.com provides the Service under the paid Subscription Fee.
  5. Subscription Fee – the remuneration paid in advance by the Client to MinistryOfAdvertising.com for the provision of the Services, additionally including the fee paid to third parties for the maintenance of the domain in a given period.
  6. Regulations – these Regulations for the maintenance of Internet domains at MinistryOfAdvertising.com Sp. z o. o.
  7. Website – www.ministerstworeklamy.pl
  8. Provision of services by electronic means – the performance of a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the Client, sent and received by means of equipment for electronic processing, including digital compression, and storage of data, which is entirely transmitted, received or transmitted via a telecommunications network within the meaning of the Act of July 16, 2004. – Telecommunications Law.
  9. Services – Services specified in these Regulations for the registration and maintenance of an Internet domain name provided by MinistryOfAdvertising.com to Customers electronically, within the meaning of the Electronic Services Act.
  10. Law on Provision of Electronic Services – Law of July 18, 2002 on Provision of Electronic Services.

IV. SCOPE OF BENEFITS

  1. As part of the Service purchased by the Customer, MinistryOfAdvertising.com undertakes towards the Customer to register and maintain an Internet domain name or maintain an Internet domain name previously registered by the Customer.
  2. The service operates on the basis of internal agreements concluded by MinistryOfAdvertising.com with third parties.
  3. The Customer, by ordering the registration or transfer of a domain to MinistryOfAdvertising.com, declares that he accepts the provisions of the Regulations, the provisions of the Regulations for the provision of electronic services within the framework of MinistryOfAdvertising.com and the rules of registration and maintenance of Internet domains of a given type.
  4. The domain maintenance service is concluded for a definite period, agreed upon by the Parties, correlated with the billing period for which the subscription fee was paid. The service is renewed with the payment of the next subscription fee, unless the Client terminates the agreement before the end of the billing period.
  5. The amount of the subscription fee for the domain maintenance service is determined individually by MinistryOfAdvertising.com with the Client. The amount of the subscription fee is subject to change in subsequent maintenance periods. If the Client does not agree to change the amount of the subscription fee, the Client may terminate the Agreement with immediate effect.
  6. Each party has the right to terminate the service one month before the end of the billing period.

V. OTHER PROVISIONS

  1. MinistryOfAdvertising.com is not responsible for the consequences of the actions of third parties, in particular, NASK, EURid, Public Domain Registry.
  2. MinistryOfAdvertising.com is not responsible for the content, correctness and legality of information provided under the registered domain.
  3. MinistryOfAdvertising.com shall not be liable for any delay in the provision of services caused by force majeure or circumstances that hinder or prevent the provision of services by MinistryOfAdvertising.com.
  4. MinistryOfAdvertising.com is not responsible for the delay of registrars in registering an Internet domain name.
  5. MinistryOfAdvertising.com does not guarantee that the selected domain name will be registered. In the event that a domain name is not available and the service cannot be provided as a result, any payments made by the Client to MinistryOfAdvertising.com will be refunded.
  6. MinistryOfAdvertising.com will, if possible, make available to the Customer, upon request, the AuthInfo code that allows the transfer of the domain to another operator.

VI. PROCUREMENT OF SERVICES. PAYMENTS.

  1. An order for a Service may be placed in any form indicated in the Regulations for Providing Services Electronically at MinistryOfAdvertising.com.
  2. When placing an order, the customer is required to provide contact information (name, surname, address, telephone number, e-mail address), as well as all necessary data for issuing an invoice.
  3. A one-time subscription fee in the amount agreed upon by the parties to the Agreement should be made in advance, to the bank account of MinistryOfAdvertising.com indicated in the pro-forma document or VAT invoice, within the period indicated in the pro-forma document or VAT invoice, which is sent at the conclusion of the Agreement to the address indicated by the Client.
  4. MinistryOfAdvertising.com, before the end of the paid Subscription Period of the Service, shall send the Client a pro-forma document covering the Subscription Fee for the next Subscription Period. Failure by the Client to pay the Subscription Fee for the next Subscription Period, after the expiration of the paid Subscription Period, shall result in the domain expiration and subsequent automatic deletion.
  5. The Customer is obliged to pay the subscription fee on time, based on a VAT invoice issued by MinistryOfAdvertising.com. The day of payment shall be the day of crediting the MinistryOfAdvertising.com bank account.
  6. The subscription fee is payable in full at one time, i.e. it cannot be paid for a period shorter than the length of the Subscription Period.
  7. MinistryOfAdvertising.com will issue a VAT invoice within 7 days from the date of recording the payment on the bank account. The VAT invoice shall be sent by e-mail or letter to the address indicated. The Customer authorizes MinistryOfAdvertising.com to issue VAT invoices for dues under this Agreement without his/her signature.

VII. FINAL PROVISIONS

  1. If any provision of these Terms and Conditions is declared invalid or ineffective, this shall not affect the validity or effectiveness of the remaining provisions of the Terms and Conditions.
  2. In matters not regulated by the provisions of these Regulations the following shall be applicable: the Regulations of providing services by electronic means as part of MinistryOfAdvertising.com, the provisions of the Civil Code, the provisions of the Act on providing services by electronic means and other relevant provisions of Polish law.
  3. These Regulations may be amended. MinistryOfAdvertising.com will inform about any changes to the Regulations by posting information on the Site. If the Customer does not accept the new content of the Regulations, he/she is obliged to notify the Company of this fact within 14 days from the date of informing about the change of the Regulations. Notification to the Company about the lack of acceptance of the new content of the Regulations shall result in termination of the Agreement for provision of services by electronic means.
  4. This version of the Regulations is effective as of 17.02.2025 and repeals the previous version of the Regulations.
